Guest Registration & Lodging Agreement

This Guest Registration & Lodging Agreement ("Agreement") is entered into between Mountain Daddies LLC, a California limited liability company doing business as Mountain Daddies Bed & Breakfast ("Mountain Daddies," "Inn," "we," "us," or "our"), and the registered guest ("Guest" or "Guests").

By completing a reservation, submitting payment, digitally accepting this Agreement, checking in or staying at the property, Guest acknowledges that they have read, understood and agree to be bound by the terms and conditions set forth herein.

1. Nature of Stay

Mountain Daddies Bed & Breakfast is a small, owner-occupied lodging establishment operating as a short-term bed and breakfast.

This reservation is a temporary lodging arrangement only and does not create any landlord-tenant relationship, leasehold interest, tenancy or residency rights under California law.

2. Reservation, Payment & Cancellation Policies

Full payment, deposit or an authorized payment method may be required prior to check-in.

Cancellation policies, refund eligibility and booking modifications are governed by the reservation terms provided at the time of booking through our website or booking platform.

No-shows, shortened stays or early departures may not be eligible for refunds.

We reserve the right to refuse or terminate accommodations for violations of this Agreement, unsafe behavior, illegal activity, excessive disturbance or conduct that negatively impacts other guests, neighboring properties or the Inn.

3. Occupancy & Registered Guests

Only registered guests included in the reservation are permitted to stay overnight at the property.

Maximum occupancy limits for each room and the property must be observed at all times.

Unauthorized guests, parties, events or gatherings are prohibited unless expressly approved in writing by management.

4. House Rules

Guests agree to comply with all posted House Rules, policies, safety instructions and reasonable requests made by management.

The House Rules are incorporated into this Agreement by reference and form part of the terms governing the Guest's stay.

5. Property Damage & Incidentals

Guests are financially responsible for damage to the property, furnishings, fixtures, linens, equipment or excessive cleaning needs resulting from negligent, reckless or intentional acts.

Guests authorize Mountain Daddies LLC to charge the payment method on file for:

  • Property damage
  • Missing items
  • Smoking remediation
  • Excessive cleaning
  • Unpaid balances
  • Violations resulting in direct financial loss

Normal wear and accidental breakage disclosed promptly to management will be handled reasonably and professionally.

6. Assumption of Risk & Liability Waiver

Guests acknowledge that the property is located in a rural mountain environment and includes features that may present inherent risks, including but not limited to:

  • Stairs and elevated levels
  • Decks and outdoor walking surfaces
  • Uneven terrain
  • Wildlife and insects
  • Weather-related conditions
  • Limited visibility at night
  • Rural roadway conditions
  • Fireplaces and heating appliances

Guests voluntarily assume all risks associated with use of the property and surrounding areas.

To the fullest extent permitted by California law, Mountain Daddies LLC, its members, managers, officers, employees, contractors, agents and representatives shall not be liable for:

  • Personal injury
  • Illness
  • Accidents
  • Loss or theft of personal property
  • Vehicle damage
  • Service interruptions
  • Weather events
  • Utility outages
  • Internet outages
  • Wildfire-related disruptions
  • Circumstances outside of reasonable control

Nothing in this Agreement waives rights that cannot legally be waived under California law.

7. Safety Acknowledgment

Guests acknowledge that smoke alarms, carbon monoxide alarms, fire extinguishers and emergency safety equipment are installed throughout the property.

Guests agree not to tamper with, disable, cover, remove or interfere with any life-safety devices.

Guests agree to promptly report hazards, malfunctions or unsafe conditions to management.

8. Accessibility Notice

Mountain Daddies Bed & Breakfast is not wheelchair accessible. It is a small, owner-occupied bed and breakfast located within our private, multi-level home in a rural mountain setting near Yosemite National Park.

Brando and Hudson are upstairs and require stairs. The Cary Grant Suite is on the first floor; there are no steps from the parking area to its entrance, but there is a step or threshold at the entrance. Grant's ensuite has a walk-in shower with grab bars. Doorway widths and wheelchair clearances have not been measured or verified, and the main dining and breakfast area cannot be reached from Grant without using stairs.

Outdoor spaces feature natural, uneven terrain. We encourage guests with accessibility or mobility concerns to review our Accessibility Information and contact us before booking.

9. Breakfast & Food Service

A homemade hot breakfast for two guests is included with each nightly room rate and is normally served between 8:00 AM and 10:00 AM. Menu selections may vary based on seasonal availability, guest count and operational considerations.

Guests are responsible for informing management in advance of food allergies or dietary restrictions. While reasonable efforts may be made to accommodate requests, Mountain Daddies Bed & Breakfast cannot guarantee an allergen-free kitchen or environment.

10. Parking & Vehicles

Guest parking is permitted only in designated parking areas.

Guests park vehicles at their own risk. Mountain Daddies LLC is not responsible for theft, damage, accidents, fallen branches, weather-related damage or loss involving guest vehicles or personal belongings.

11. Communication & Text Message Consent

By providing a phone number during booking or check-in, Guest expressly consents to receive communications from Mountain Daddies Bed & Breakfast related to their reservation and stay, including but not limited to:

  • Reservation confirmations
  • Booking updates
  • Check-in instructions
  • Property information
  • Safety notifications
  • Arrival coordination
  • Customer service communications
  • Follow-up communications regarding the stay

These communications may be sent via phone call, email or text message (SMS/MMS).

Message and data rates may apply depending on the Guest's mobile carrier plan.

Guests may opt out of non-essential text communications at any time by notifying management or replying STOP to text messages when applicable.

Mountain Daddies LLC does not sell guest contact information or share it with third parties for independent marketing purposes.

12. Privacy

Guest information collected during the reservation or stay process will be used for reservation management, guest communication, operational purposes and legal compliance. Please review our Privacy Policy.

13. Force Majeure & Service Interruptions

Mountain Daddies LLC shall not be liable for circumstances outside its reasonable control, including but not limited to wildfires, public safety power shutoffs, utility interruptions, severe weather, road closures, government actions or emergencies.

14. Governing Law & Dispute Resolution

Governing Law. This Agreement and any dispute arising out of or relating to this Agreement, a reservation, a stay at Mountain Daddies Bed & Breakfast, the property, or services provided by Mountain Daddies shall be governed by the laws of the State of California, without regard to conflict-of-law principles.

Informal Resolution. Before initiating arbitration, either party shall provide the other with written notice describing the dispute and the relief requested. The parties agree to make a good-faith effort to resolve the dispute informally for at least thirty (30) days after receipt of the notice.

Binding Arbitration. Except for matters eligible for small claims court as described below, any dispute, claim, or controversy arising out of or relating to this Agreement, a reservation, a stay, the property, or services provided by Mountain Daddies that cannot be resolved informally shall be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules then in effect.

The arbitration shall be conducted by a single neutral arbitrator. Unless applicable law or the AAA Consumer Arbitration Rules require otherwise, the arbitration shall take place in Madera County, California, or may be conducted remotely by video, telephone, or submission of documents when agreed by the parties or permitted by the applicable rules.

The arbitrator may award any individual remedy or relief that would otherwise be available to the parties under applicable law. Judgment on the arbitrator's award may be entered and enforced in any court having jurisdiction.

Small Claims Court. Either party may bring an individual claim in an appropriate small claims court instead of arbitration when the claim qualifies for small claims jurisdiction. Nothing in this section prevents either party from exercising rights available under the AAA Consumer Arbitration Rules concerning small claims proceedings.

Arbitration Costs. Arbitration fees and costs shall be allocated in accordance with the AAA Consumer Arbitration Rules and applicable law. Mountain Daddies will pay any arbitration fees or costs that it is required to pay under those rules or applicable law.

Individual Proceedings. To the fullest extent permitted by applicable law, disputes shall be resolved on an individual basis and not as a class, collective, consolidated, or representative action. Neither party may seek relief on behalf of other persons in arbitration except where applicable law provides otherwise.

WAIVER OF JURY TRIAL. BY AGREEING TO BINDING ARBITRATION, MOUNTAIN DADDIES AND THE GUEST UNDERSTAND AND AGREE THAT COVERED DISPUTES WILL BE DECIDED BY A NEUTRAL ARBITRATOR RATHER THAN BY A JUDGE OR JURY, EXCEPT FOR CLAIMS PROPERLY BROUGHT IN SMALL CLAIMS COURT OR OTHER MATTERS THAT APPLICABLE LAW DOES NOT PERMIT TO BE ARBITRATED.

Court Proceedings. If a dispute is determined not to be subject to arbitration, or if court proceedings are necessary to enforce this arbitration provision or an arbitration award, the parties consent to jurisdiction and venue in the state or federal courts having jurisdiction over Madera County, California, except where applicable law requires otherwise.

Severability. If any portion of this Section 14 is determined to be invalid or unenforceable, that portion shall be severed or limited to the minimum extent necessary, and the remainder of this Section shall remain in effect to the fullest extent permitted by law.

15. Acknowledgment & Agreement

Guest acknowledges that all lodging services are provided by Mountain Daddies LLC and that any claims arising from the reservation, property or stay shall be directed solely to Mountain Daddies LLC to the fullest extent permitted by law.

By digitally accepting this Agreement, checking the required agreement box during booking, signing electronically, checking in or staying at the property, Guest acknowledges that they have read, understood and agree to be bound by the terms of this Agreement and the House Rules.
